Does Your Painter Know About The Lead Paint Lawsuit?

Although painting contractors are vigilant in the products that they use, they still must watch carefully as recently, this California lawsuit judgment in over a billion dollars was awarded.  Companies such as Sherwin Williams, Conagra, and NL Industries were found guilty in a Santa Clara Court for knowingly marketing lead paint.  Although prior to 1978 when the legislation  first was handed down, this was an issue, there are still health risks that old paint are causing. 


The named companies have a fifteen day response period to the court decision however it appears that this award was targeted to enable funds to be allocated in order to remove older buildings that have pre-1978 lead paint still in existence that can still be harmful. 


With children diagnosed with lead paint and affected by this, the defendants maintain that older paint dating this far back is no longer a problem.  There are still a lot of pre-1978 paint that exists on walls where this risk factor still poses a danger.  Where then does this liability get capped?  According to this court decision, it is incumbent upon the paint manufacturers to provide a reserve fund that must be allotted to make restitution on this contingent liability. 


Now the question rests upon the painting contractors that buy the paint from the manufacturers.  Although it seems that with current paint past the 1978 date of lead manufactured paint, this should no longer be a problem.  Painters should still be vigilant in carefully choosing their brands and contents of the brands before applying any paints and chemical usage i.e. turpentine that may be in a household exposing people to any adverse effects.
