1.       Manzoor Memon intentionally published defamatory statements against Haroon   Shaikh;

2.       These statements were defamatory intended to injure HAROON SHAIKH’s reputation and exposed him to public hatred, ridicule, and impeach his honesty, integrity, virtue and reputation;

3.       These defamatory statements were FALSE;

4.       Manzoor Memon knew or should have known these statements were defamatory and caused harm to Haroon Shaikh;      

5.       The Jury found by “Clear and convincing evidence” that harm to Haroon Shaikh was from MALICE (Specific intent to cause substantial injury and harm to Haroon Shaikh;

6.       Manzoor Memon had actual awareness of risk of harm that was created by his defamatory statements but preceded with conscious indifference to the rights, safety and welfare of Haroon Shaikh and others;

7.       The Jury awarded following sums as damages: Mental Anguish (Actual)$100,001; Harm to Reputation (Actual) $250,001; Punitive Damages $350,000; Total Damages $700,002.                                          

The Court entered a Judgment in favor of Haroon Shaikh for all of the damages awarded by the Jury in the amount of $700,002.  The Court also added $15,917 as Pre- judgment interest plus future interest @ 5% per annum beginning October 3, 2011, until JUDGEMENT IS PAID IN FULL.

The Court, based on the findings of the Jury and other evidence, found that Manzoor Memon has engaged in wrongful conduct and he will likely continue that wrongful conduct after the Judgment and therefore a PERMANENT INJUNCTION against Manzoor Memon is justified by the Court.

The PERMANENT INJUNCTION imposed by the Court recites in pertinent part:

“…Manzoor Memon is ordered and commanded to immediately and permanently desist and refrain from writing, publishing, republishing, circulating, broadcasting or communicating any of the defamatory statements or comments concerning Haroon Shaikh.  This permanent commandment applies to all websites, blogs, emails, broadcasts, blasts, text messages, tweets, memoranda, radio transmission, television transmission, faxes, flyers, newsletters, newspapers, correspondence, books, e-books, or other written communications of any type, and it further requires Manzoor Memon to remove all web pages, web postings, archives, prior publications, or other items on any website under direct or indirect control of Manzoor Memon containing any of these defamatory statements or comments from the internet. This commandment specifically prohibits Manzoor Memon from republishing any of the defamatory statements or comments in any way, form, or fashion, on or after the Judgment…”  In addition Manzoor Memon has to pay the costs of court.  The Judgment was signed by the Court on October 3, 2011.

There is a movement among the facbook community especailly with SEO strategies focusing on social networking. SEO srategies should not come attached with having to deal with some moron I hated in high school or an ex co-worker who had personal hygene issues.  People, it is ok not to friend past people who you really never liked.  I am not going to judge you and Facebook although quickly living up to its vain name, should either.

I beleve this video will take off because chances are you are as fed up as I am about receiving Facebook invitations from every bozo that ever got their hands on my business card or looked me up in the high school yearbook? I have yet to get one of those invites from a big shot Hollywood agent begging for me to come audition for the newest blockbuster based on my dazzling profile — instead it seems like every geek and pushy sales person I ever encountered has managed to find me again and is trying to suck me into their Facebook world!  Trust me this is no way on creating a sustainable SEO strategey with or without Facebook.

I am really becoming convinced that all these social networks, especially facebook are just a huge waste of my time. When it comes to Saving Energy Optimitization  (SEO).  Consider how the rise of social networking coincided with the peak of foreclosures and the onset of the credit crunch, I have to wonder if there is a dark side lurking behind the perky myth of the ‘connect with the world’ via networks like Facebook. I mean, why does it seem that every idiot you have successfully avoided over the years has now been able to find you and thanks ti facebook figured out a way of wasting your valuable time with invitations to mafia wars, farmville or some other time wasting matter.

With the interent in its infancy, it is unerstandable of where are the rules and etiquette of de-friending Facebook haunts. When posed with such a dilema I think you will find comfort that there is a SEO mantra you can resort to  “I didn’t like you before and I dont like you NOW, so I therefore must de-friend you before I tell you what you can do with that fricken Farmville Cow“

Health insurance companies over the years have claimed to be able to balance the needs of their policyholders with those of their stockholders. These needs are in direct conflict of each other and because of this health insurance companies have ended up providing inferior health care while misrepresenting their bottom line to stockholders.

The courts determined that health insurance companies have a fiduciary duty to their clients. Health insurance companies are not like other corporations because they are not merely providing goods or services but are representatives entrusted to act in their clients’ best possible interests. Insurance companies cannot make the best unbiased recommendations in the interest of their clients when higher profits are demanded by their stockholders.

In order to improve their bottom lines, health insurance companies have enacted policies in the past that were not based on their clients’ best medical interests. Such policies include the offering of financial incentives to physicians for not recommending specialists to patients. To make matters worse, cases of the patient’s health suffering because of poor policies were typically won by the insurance companies because of an act called ERISA. ERISA outlined measures to help insurance companies keep health care costs down. Under ERISA a health insurance company was not required to disclose any incentive policies even those that affected a patient’s health.

Another way that health insurance companies have protected their financial profits at the expense of the health of their clients is by suddenly dropping their coverage. This is called rescission. Rescission is when the insurance company will no longer cover a client. The clients who lose their coverage due to rescission are usually those diagnosed with prolonged illness and who require expensive health care coverage.

A ruling, however, in 2002 by the Supreme Court determined that an insurance company could only drop a client for reasons listed explicitly on the insurance plan. As a result of this ruling, rescinded patients have more leverage to win lawsuits against insurance companies.

Another law passed in 2002 outlines stricter rules for financial disclosure from corporations. Companies must now report to the SEC any possible future financial losses. Health insurance companies should be reporting the possible losses they may have due to lawsuits and also the greater expenses on medical treatments they are now forced to provide in order to prevent lawsuits. Health insurance companies who fail to disclose any factors that affect potential earnings are misrepresenting their financial health and may be sued by the stockholders for fraud.
