(Newswire.net — April 30, 2013) Sacramento, CA — No parent ever wants to see their child suffer, and most would lay down their own lives for the sake of their children. Anna Nikolayev and her husband Alex are no different. Their 5 month old son, Sammy, who suffers from a heart murmur, was admitted to the ER of Sutter Memorial Hospital, with “Flu-like symptoms.” Anna and Alex were less than impressed with some of the care Sammy received, including nurses administering shots of antibiotics that the nurses were not for certain were what they claimed to be.
So when it was suggested to the couple that heart surgery was necessary, they opted to get a second opinion. This did not sit well with some of the medical professionals at Sutter. Although one doctor, who signed off on the paperwork for the Nikolayevs, said that he thought there was no immediate danger to the child, moments before the family left, police showed up. They read the doctor’s evaluation and let Alex and Anna go home with Sammy, but they then showed up at their home the next day, and took Sammy into custody. Anna had the wherewithal to set up a camera and record the event, and it is quickly garnering a lot of attention, as the cops seem to let themselves in with no warrant, and proceed to take Sammy while issuing threats about resisting.
Many people never get such incidents on tape, however, and thousands of children are removed from their homes every year under similar circumstances. Justin West, who has worked for 10 years with a legal insurance provider dedicated to making sure that average people can get access to the justice system, says this is all to common. “The simple rule is this,” states Mr. West, “If you don’t know your rights, you don’t have them. I guarantee that, were the Nicolayevs wealthy people, they’d have an attorney on speed-dial. The moment the police showed up, they’d have said ‘I want to speak to my attorney,’ and they would have meant it and had access.”
Mr. West says that most people can’t afford an attorney on retainer, and that a service like what his company offers is probably the best defense against an attack upon their rights. “The national average cost of an attorney is around $250/hour, and most people aren’t even making $25/hour, so the system is unbalanced. You shouldn’t only get the amount of justice you can afford, and we’re changing that. We can give our clients reasonable 24 hour a day emergency access to an attorney for situations just like this one.”
