Scottsdale Motor Vehicle Accident Lawyer Weighs-In on General Motors Probe

The problem with the defect is that a shut-off engine hinders the deployment of airbags, which can be fatal in the event of an accident.


In July 2013, Toyota settled an automobile defect class suit arising from a faulty accelerator design. The settlement ended years of litigation which addressed only the plaintiffs claim that the defect and subsequent recall caused the devaluation of their vehicles. Toyota is still facing personal injury claims, including death, that may have been caused by the accelerator defect.

Now, GM is facing a similar dilemma as several reports, including this one published by the New York Post, links the ignition key defect with 31 crashes and 13 deaths. What is more, the motor company and NHTSA appears to be aware of the fault for almost a decade—having received numerous complaints as early as the mid-2000’s when sale of American cars was at the highest—but has done little to correct the problem. Now, the U.S. House of Representatives and Senate are poised to investigate as to why the government watchdog NHTSA failed to act sooner on the complaints according to Chairman of the House Committee on Commerce Fred Upton (R-Michigan).
