Gabriel Fernandez, an eight year old boy, was found unconscious on the 22nd of May 2013 after his mother called the paramedics. It turned out that Gabriel was not only unconscious but also had a cracked skull, three broken ribs, his teeth were severely bashed and his groin and lungs injured. The young boy was declared brain dead and he died two days later. It was revealed Gabriel’s mother, Pearl Fernandez and her partner, Isauro Aguirre played a key role in the torturous actions that led to his death.
The brutal killing of eight year old Gabriel shook the entire world and none of us could believe something so tragic could happen to an innocent child. Initially during the trial, the District Attorney had sought the death penalty against the couple. But only the boyfriend, Isauro Aguirre, faced the death penalty. According to Deborah S. Miora, a clinical psychologist who evaluated Fernandez during the trial, she suffered from severe limited intellectual capacity. This left her incapable of using thought to properly guide her behavior and emotional reactions.
On the 15th of February 2018, Fernandez did plead guilty to one count of first-degree murder and also admitted to the special circumstance intentional murder by torture allegation. She was later sentenced to life in prison without parole. She is currently serving her term at the Chowchilla State Women’s Prison. Fernandez was spared the death penalty after she agreed to take a plea. That being said, she recently filed court papers requesting a new hearing in her case.
Isauro Aguirre was found to have been a major participant in the brutal torture and heinous murder of Gabriel. It came to light that Aguirre gagged, bound and whipped the young boy and even forced him to eat feces. Unlike his girlfriend, Aguirre was given the death penalty. He is now at the San Quentin prison waiting for his time alongside other notorious murderers.
