Longman & Van Grack Testifies on Maryland Tax Legislation

The House’s Ways and Means Committee held a hearing on HB 1054. The Comptroller of Maryland is currently required to assess a penalty against taxpayers who fail to file their tax returns timely or who fail to fully pay the tax liability due. Like any law there are exceptions and situations when the penalty amount is increased or when the penalty amount can be waived. In Maryland, the penalty for the failure to file a tax return and failure to pay income taxes is not be greater than ten percent of the unpaid tax. When a tax return has a liability due, the penalty will be assessed against the taxpayer. The Comptroller of Maryland is not required to impose the full amount of the penalty against all taxpayers, but in most cases it does assess the full ten percent penalty.

HB 1054 will increase the penalty for failure to pay taxes. The penalty would increase to a mandatory 10 to 25 percent. The penalty amount would increase based upon the length of time a taxpayer is late in making payment. The penalty amount would start with 5 percent for 30 days of failure, and would continue to increase until 120 days, when the full 10-25 percent penalty could go into effect. Mr. Longman argued to the Maryland House of Delegates that this bill would have a damaging effect on taxpayers who were unable to make timely tax payments due to financial hardships.
