A client recently received $170,000 in a personal injury case against an insurance company. The federal worker was previously injured and compounded those injuries in a motor vehicle accident. Bruce Ginsburg stated “From our standpoint, we consistently see cases in which auto, truck and motorcycle insurance companies don’t want to act reasonably toward their insured. In this case, the client bought uninsured and under insured motorist coverage in his own Pennsylvania policy. He had prior injuries, but had bounced back from the care that he had a few years earlier. However, in our view it left him more susceptible to re-injury.

The insurance company, when presented with the uninsured motorist claim, tried to minimalize his injuries and the impact the injuries had upon he and his wife. We sued the insurance carrier for the injuries and for bad faith. We were happy to get this case promptly heard and a great verdict for this husband and wife.”

Filing a claim against an insurance company can often be an uphill battle. Even if you sustain minor injuries, it is imperative that you document any notes about an accident. Obtaining a copy of the police report on the accident can help your individual case. Even though we all accept some risk while driving, no one should have to suffer from any negligence on behalf of someone else. Being involved in an accident and sustaining any serious injuries can be a traumatic experience. Therefore, it is important to get legal help that knows how to speak with claim adjusters and reach a fair settlement.
